These Terms and Conditions ("Terms") apply to your use of worldkitchendesigns.com (the "Website") and to consultations, measurements, designs, estimates and online purchases provided by World Kitchen Designs ("World Kitchen Designs," "we," "us" or "our"), located at Emporium Shoppes, 4603 Okeechobee Blvd, C122-C123, West Palm Beach, FL 33417. By using the Website, booking an appointment or buying from us, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Website or our services.

1. Your project agreement comes first

Remodeling, cabinetry, countertop and installation work is performed only under a separate written proposal or contract signed by you and World Kitchen Designs (a "Project Agreement"). The Project Agreement sets out the scope of work, price, payment schedule, timeline, warranties and cancellation terms for your project. If anything in these Terms conflicts with a signed Project Agreement, the Project Agreement controls.

2. Complimentary consultations and measurements

• Showroom consultations and in-home measurements offered as "complimentary" or "free" are provided at no charge and with no obligation to buy.
• Appointments booked online are requests until confirmed by us. We may need to reschedule because of weather, illness, traffic or other circumstances, and we will contact you if that happens.
• Please give us at least 24 hours' notice if you need to cancel or change an appointment.
• An adult (18 or older) who owns the property or is authorized by the owner must be present during an in-home visit.
• In-home visits are offered within our service area in Palm Beach County and nearby communities. We may decline or reschedule appointments outside that area.

3. Designs, drawings and estimates

• Preliminary estimates and quotes are based on the information and measurements available at the time. They are not final prices. Your final price is the price stated in your signed Project Agreement.
• Unless stated otherwise, estimates are valid for 30 days. Material prices, availability and lead times are set by manufacturers and may change.
• Final pricing requires verified site measurements taken by our team. We are not responsible for errors resulting from measurements provided by you or others.
• Designs, layouts, drawings and 3D renderings we create remain our property until your project is paid in full. You may not give them to another company to build or price without our written permission.

4. Product information, colors and samples

We try to show our products accurately, but photos, screens and printed samples may not match actual colors, wood grain, stone veining or finishes exactly. Natural materials such as wood, quartz, granite and marble vary from piece to piece, and those natural variations are not defects. Photos on the Website include completed projects and design inspiration; not every item shown is a stock product.

5. Orders, deposits and custom items

• Most cabinetry, countertops and many other items are custom-made or special-ordered for your project. Once a custom or special order has been placed with the manufacturer, it generally cannot be cancelled, changed or returned.
• Deposits, payment schedules and cancellation rights for projects are set out in your Project Agreement.
• Returns of eligible stock items purchased online or in the showroom are governed by our Refund Policy.
• Prices do not include applicable taxes, delivery, permit fees or other charges unless stated in writing.

6. Your responsibilities

Unless your Project Agreement says otherwise, you are responsible for providing safe access to the work area, obtaining any required homeowner or condominium association approvals, telling us about known conditions (such as hidden plumbing, electrical, mold or structural issues), and making timely selections and payments. Delays caused by late selections, change orders, access issues or concealed conditions may change the schedule and price.

7. Schedules and delays

All delivery and installation dates are estimates. We are not responsible for delays caused by manufacturers, shipping carriers, permit offices, inspections, weather, hurricanes, supply shortages or other events beyond our reasonable control.

8. Warranties

Products are covered by their manufacturers' warranties, which we will help you use. Any warranty on our workmanship is provided only as written in your Project Agreement. Except as stated in a Project Agreement or required by law, the Website and its content are provided "as is," without warranties of any kind.

9. Financing

Any financing is offered by independent third-party lenders and is subject to credit approval and the lender's own terms. World Kitchen Designs is not a lender and does not make credit decisions.

10. Communications

By giving us your phone number or email address, you agree that we may contact you by call, text or email about your inquiry, appointment or project. Message and data rates may apply. You may opt out of marketing messages at any time by replying STOP or using the unsubscribe link.

11. Website content and intellectual property

The Website's text, photos, designs, logos and other content belong to World Kitchen Designs or its licensors and are protected by copyright and trademark law. You may view and share pages for personal, non-commercial use, but you may not copy, sell or reuse our content without our written permission. Some photos are licensed from third parties and are used for design inspiration.

12. Reviews and feedback

If you send us reviews, comments, photos or suggestions, you allow us to use them to operate and promote our business. We will ask your permission before publishing photos of your home and will not publish your name or address without your consent.

13. Third-party tools and links

The Website uses or links to services run by others, such as our Microsoft Bookings calendar, Google Maps, Instagram and Facebook. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them.

14. Acceptable use

You agree not to misuse the Website, including by submitting false information or fake bookings, attempting to interfere with its security or operation, scraping or copying content in bulk, or using it for any unlawful purpose.

15. Limitation of liability

To the fullest extent permitted by law, World Kitchen Designs is not liable for any indirect, incidental, special or consequential damages arising from your use of the Website or its content. Our liability for any project is limited to the terms of the applicable Project Agreement. Nothing in these Terms limits any rights you have that cannot be limited under Florida law.

16. Indemnification

You agree to indemnify and hold harmless World Kitchen Designs and its owners, employees and contractors from claims arising out of your misuse of the Website or your violation of these Terms.

17. Relationship with Shopify

The Website and online store are powered by Shopify. Any sales and purchases you make are made directly with World Kitchen Designs. Shopify is not responsible for any aspect of sales between you and World Kitchen Designs, including any injury, damage or loss resulting from products and services purchased, and you release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with World Kitchen Designs.

18. Governing law

These Terms are governed by the laws of the State of Florida. Any dispute relating to these Terms or the Website will be brought in the state or federal courts located in Palm Beach County, Florida, unless your Project Agreement provides otherwise.

19. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Your continued use of the Website after changes are posted means you accept the updated Terms.
